With a power of attorney, you can name an agent or representative (a relative or friend, for example) who will act on your behalf. The power of attorney will be effective during your lifetime unless you elect to change it.
- An Illinois Power of Attorney for health care enables a person you trust to make important health care decisions about you. If you are unable to make your own decision, you will know that someone else will be empowered to take on that responsibility. It could be a transitory situation (a decision that needs to be made during surgery, for example) or a lengthier situation (dementia, for example). Talk to your estate planning lawyer about a health care power of attorney.
- Who will manage your finances if you cannot? With a Power of Attorney for property, you can select a trusted person to handle your finances — pay your bills, monitor your retirement accounts and other investments, or manage any property that is not in trust.
Without powers of attorney in place, your family may be faced with petitioning the court for guardianship. If you are facing a temporary disability or planning a trip, it is wise to have the appropriate powers of attorney in place in case you need them.
